IMPORTANT: BY LOGGING INTO YOUR ACCOUNT, SIGNING UP FOR ANY OF OUR SERVICES, OR UPDATING ANY FILES, YOU ARE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS, THE ACCEPTABLE USE POLICY, AND THE PRIVACY POLICY. WE CANNOT ACCEPT ANY RESPONSIBILITY FOR ANY LOSS OF BUSINESS OR DATA WHICH MAY OCCUR FROM SERVICES BEING CANCELLED AS A RESULT OF INFRINGEMENT OF THESE TERMS.
BoltConnect is the trading name of BOLTCONNECT LTD (hereinafter referred to as "BoltConnect"), a provider of internet related services including (but not limited to) website hosting, e-mail, VPS hosting, managed servers, server hardware and domain name services. These conditions set out the terms under which BoltConnect will provide services to the client.
These conditions are intended to be read with the Acceptable Use Policy (hereinafter referred to as the "AUP"). This policy can be viewed at the following location:

BOLTCONNECT LTD IS A COMPANY BASED IN THE UK, AND IS THEREFORE SUBJECT TO UK LAW. BY SIGNING UP FOR ANY OF OUR SERVICES, THE CLIENT AGREES TO BE BOUND BY AND ADHERE TO UK LAW IN ADDITION TO THE LAWS GOVERNING THE ORIGIN COUNTRY OR STATE OF THE CLIENT.
Trial Period
BoltConnect may, at its sole discretion, provide a "free trial" period for any services offered. BoltConnect reserves the right, at its sole discretion, to ask for a monetary deposit to be secured against any damage to the server(s) or service(s) offered by BoltConnect. In the event that service is terminated by BoltConnect because of a breach in the terms & conditions or AUP, any deposit paid by the client will not be refunded. BoltConnect also reserves the right to cancel the agreement and/or service(s) offered to the client without notice and for any reason during the "trial period". This does not affect your statutory rights.
Termination/Cancellation
Clients may cancel their service(s) at any time, but will not be able to claim a pro-rata refund for any unused days left in the current billing cycle. If a deposit was paid, this will be refunded except where service was terminated by BoltConnect due to a breach of the terms and conditions or the AUP by the client.
If the client is found by BoltConnect to contravene any part of the terms and conditions of service or the AUP, BoltConnect may at its sole discretion cancel all agreements and service(s) with the client without notice. In this circumstance, no refunds of any kind (including the deposit) will be due.
Notwithstanding the exceptions stated above, BoltConnect may cancel all agreements and service(s) with the client by giving a notice period of 1 (one) calendar month, no refunds will be due except the deposit if one was paid by the client. This does not affect your statutory rights.
AFTER TERMINATION OF SERVICE, ANY DATA FROM THE CLIENT REMAINING ON SERVERS OWNED BY BOLTCONNECT MAY BE PERMENANTLY DESTROYED.
False information
If during the signup process or when speaking to a BoltConnect representative the client knowingly provides false information, any agreement and/or service(s) provided to the client by BoltConnect will be void, and BoltConnect will take appropriate action outlined in the termination/cancellation policy.
BoltConnect reserves the right to persue any damages caused by such actions (or any other action which is illegal under UK law or which contravenes the terms & conditions) in court.
Definition of Terms
- Agreement
The agreement between BoltConnect and the client for the provision of service(s).
- AUP
The acceptable use policy: http://www.boltconnect.co.uk/AcceptableUsePolicy.aspx
- Charges/Fees
The monies owed to BoltConnect under the agreement relating to the services, as per the order confirmation.
- Client
As identified in the order confirmation.
- Customer
As identified in the order confirmation.
- Equipment
Any physical hardware, cabling, or other equipment provided to the client by BoltConnect in accordance with the agreement.
- Services
The physical, software, hardware, consultancy, support and other services provided to the client by BoltConnect in accordance with the agreement.
- Working Day
A day of the week which is not one of the following in England and Wales: Saturday, Sunday, public holiday, bank holiday.
Limitation of Liability and Disclaimer
The client agrees that it shall defend, indemnify, save and hold BoltConnect harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against BoltConnect, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the client, its agents, employees or assigns. The client agrees to defend, indemnify and hold harmless BoltConnect against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with BoltConnect; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from BoltConnect.
BoltConnect will not be responsible for any damages you or your business may suffer. BoltConnect makes no warranties of any kind, expressed or implied for services we provide. BoltConnect does not explicitly guarantee to back up your data or website and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, BoltConnect cannot guarantee to be able to replace any lost data. BoltConnect disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by BoltConnect and its employees. BoltConnect reserves the right to revise its policies at any time.
